These Terms of Use and Conditions of Sale (the "Terms") are a binding agreement between Pure Karting, LLC, an Arizona limited liability company ("Pure Karting", "we", "us", or "our"), and you ("you" or "your"). They govern your access to and use of www.purekarting.com (the "Site"), your purchase of our products and services, and your participation in our text messaging program (together, the "Services").

By using the Site, placing an order, or opting in to our text messages, you accept these Terms. If you do not agree, do not use the Services. Our Privacy Policy is incorporated into these Terms by reference.

1. Eligibility and Accounts

You must be at least 18 years old and able to form a binding contract to purchase from us or to enroll in our text messaging program. If you create an account, you are responsible for keeping your credentials confidential and for all activity that occurs under your account. Notify us immediately at support@purekarting.com if you suspect unauthorized use.

2. Text Messaging Program (SMS / MMS / RCS)

This Section 2 governs the Pure Karting text messaging program and is the complete messaging disclosure for the program.

2.1 Program Description

Program name: Pure Karting Customer Notifications.

By opting in, you agree to receive text messages from Pure Karting, LLC at the mobile number you provided. Messages are limited to the following types:

  • Customer care and support — replies to your questions, quotation requests, helpdesk tickets, and service inquiries, including two-way conversational messages.
  • Order and shipping updates — order confirmations, backorder and stock notices, shipment and tracking notifications, and delivery updates.
  • Account and billing notices — quotation ready notices, invoice and payment due reminders, payment confirmations, and subscription renewal notices.

We do not send marketing or promotional text messages under this program.

2.2 How to Opt In

You may enroll by any of the following methods:

  • Checking the SMS consent box on a form on our Site, including our contact form;
  • Checking the SMS consent box when you create an account. An account is required to complete a purchase, so this box is presented to you during checkout;
  • Giving your mobile number and consent verbally to a Pure Karting representative in person or by telephone.

Consent to receive text messages is not a condition of purchasing any goods or services. You represent that the mobile number you provide is your own, or that you are authorized to consent on behalf of the subscriber, and you agree to notify us if the number is reassigned.

2.3 Message Frequency and Cost

Message frequency varies based on your orders and your interactions with us. Message and data rates may apply. Any charges are billed by, and payable to, your mobile service provider. Contact your carrier for details about your plan.

2.4 How to Opt Out (STOP)

You may cancel at any time by replying STOP to any message you receive from us. You will receive a single message confirming your unsubscribe request, after which we will send you no further text messages. You may also opt out by emailing support@purekarting.com or calling +1 602-492-5278. To rejoin, opt in again using any method in Section 2.2.

2.5 How to Get Help (HELP)

For help, reply HELP to any message, email support@purekarting.com, or call +1 602-492-5278. Our customer care team is available Monday through Friday, 9:00 a.m. to 5:00 p.m. Arizona time (MST, no daylight saving).

2.6 Carriers, Devices, and Delivery

Supported carriers include AT&T, Verizon Wireless, T-Mobile, US Cellular, Boost Mobile, MetroPCS, Cricket, and most other U.S. carriers. Carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your carrier and is not guaranteed. Message delivery may fail for reasons outside our control, including network outages, roaming, an out-of-range or powered-off device, or an unsupported handset. You are responsible for maintaining a device capable of receiving text messages.

2.7 Privacy

Information collected through the text messaging program is handled as described in our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

3. Quotations, Orders, and Pricing

Quotations are valid for the period stated on the quotation and are subject to change and to availability. All orders are subject to our acceptance. Prices are in U.S. dollars and exclude taxes, shipping, and handling unless expressly stated. Arizona residents are subject to applicable Arizona transaction privilege tax. Shipping and handling charges may apply. We reserve the right to correct pricing, description, or availability errors and to cancel any affected order.

Pure Karting will not be held responsible for errors on orders placed without a part number.

4. Payment Terms

  • Invoices are payable in accordance with the terms stated on the invoice or order.
  • Accounts not paid within terms are subject to a finance charge of 2% per month on the outstanding balance, or the maximum rate permitted by law, whichever is less.
  • Returned or cancelled payments are subject to a $35.00 charge plus any applicable bank fees.
  • Fees may be added to accept certain forms of payment. A convenience fee of 3%, or the exact calculated processing fee, will be added to all credit card and PayPal payments.
  • You are responsible for all costs of collection, including reasonable attorneys' fees, on past-due balances.

5. Shipping, Title, and Claims

Risk of loss passes to you upon delivery to the carrier unless otherwise agreed in writing. Delivery dates are estimates and are not guaranteed.

Missing items, invoicing or shipping errors, and damaged items must be reported within 72 hours of receipt. Claims submitted after that period may not be honored.

6. Returns and Restocking

  • No returns after 30 days, and no returns without prior written authorization.
  • No returns on electrical goods, special orders, used items, or discontinued items.
  • Authorized returns are subject to a 20% restocking fee.
  • Team support fees are non-refundable.
  • Returned goods must be unused, in original packaging, and shipped prepaid unless the return results from our error.

7. Shop Fees and Disposal Charges

Shop fees charged by Pure Karting cover supplies, equipment, and materials used in quantities impractical to measure for each job. These include, but are not limited to, worn-out items and tools, lubricants, solvents, small nuts, bolts, washers, clamps, and adhesives. They also cover health and safety equipment required to conform to state and local labor laws, such as eye protection, back supports, protective gloves, and disposal of shop mop water.

Disposal charges applied to specific services and products are not included in the shop fee calculation. These charges are specific to the proper disposal of hazardous or regulated scrap or waste arising from the service or product, including but not limited to waste oil and filters, brake fluid, and scrap tires.

8. Storage and Uncollected Equipment

Storage fees will be charged on all materials not collected within 10 days of job completion. Equipment may be sold as payment against open balances if not collected within 6 months after job completion, to the extent permitted by Arizona law.

9. Assumption of Risk and Safety Warning

WARNING: KARTING IS DANGEROUS AND CAN CAUSE SERIOUS INJURY OR DEATH. Always wear a helmet and other industry-approved safety equipment. Pure Karting's products and services are intended solely for use on closed circuits operating with participant insurance in place. They are not intended or approved for use on public roads.

You assume and acknowledge all risks related to the use of these products and services, and you are solely responsible for their proper selection, installation, inspection, maintenance, and safe use.

10. Warranty Disclaimer

All products are sold without written or implied warranty except where a manufacturer's warranty applies, in which case that warranty is passed through to you to the extent permitted by the manufacturer. To the fullest extent permitted by law, the Services and all products are provided "as is" and "as available", and Pure Karting disclaims all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

11. Limitation of Liability

To the fullest extent permitted by law, Pure Karting and its members, managers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, personal injury, or property damage arising out of or relating to the Services, whether based in contract, tort, strict liability, or any other theory, even if advised of the possibility of such damages. Our total aggregate liability arising out of or relating to the Services will not exceed the amount you paid to us for the product or service giving rise to the claim.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

12. Acceptable Use

You agree not to use the Services to violate any law; to infringe our or a third party's intellectual property; to transmit malware, spam, or unsolicited messages; to scrape, probe, or overload the Site; to attempt unauthorized access to any system or account; or to misrepresent your identity or authority. We may suspend or terminate access for any violation.

13. Intellectual Property

The Site and its content — text, graphics, logos, images, product data, and software — are owned by Pure Karting or its licensors and are protected by intellectual property laws. You may view and print content for your own internal, non-commercial use. Any other reproduction, distribution, modification, or commercial use requires our prior written permission.

14. Third-Party Links

The Site may link to websites we do not control. We do not, directly or indirectly, imply approval, association, sponsorship, endorsement, or affiliation with any linked website unless expressly stated. Review the terms and privacy policy of any site you visit; your use of off-site pages is at your own risk.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Arizona, United States, without regard to its conflict of laws rules. You and Pure Karting agree to the exclusive jurisdiction and venue of the state and federal courts located in Maricopa County, Arizona, and waive any objection to that venue. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

16. Changes to These Terms

We may update these Terms from time to time. Revisions take effect when posted on this page, and we will update the "Last Updated" date above. Your continued use of the Services after a change takes effect constitutes acceptance. Material changes to the text messaging program in Section 2 will be communicated to enrolled recipients where required by law or industry standards.

17. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with our Privacy Policy and Cookie Policy, are the entire agreement between you and Pure Karting regarding the Services.
